Terms and Conditions

§1 Scope
These General Terms and Conditions ("Terms") apply to all orders placed via the online shop of Lemon Pharma GmbH & Co. KG ("LEMON") at www.lemon.shop in the version valid at the time of the order.

§2 Contract Conclusion
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding invitation to place an order. By clicking the “Buy” button, you submit a binding offer to purchase the items in your shopping cart. The confirmation of receipt follows immediately and does not constitute acceptance. A contract is only concluded when we accept your order by separate confirmation email or by dispatching the goods.

Contracts are concluded exclusively in German. The contract partner for all orders is:

§3 Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days without providing a reason. The withdrawal period is 14 days from the day you or a third party named by you (not the carrier) took possession of the goods.

To exercise your right of withdrawal, you must notify us by means of a clear statement (e.g., letter, fax, or email). You may use the form below, which is not mandatory:

Effects of Withdrawal We will reimburse all payments received, including standard delivery costs (excluding additional costs for express delivery), within 14 days from receiving the withdrawal notice. Reimbursement will use the original payment method unless otherwise agreed.

We may withhold reimbursement until goods are returned or proof of return is provided. You must return goods within 14 days of the withdrawal notice. Return costs are borne by us if our return label is used. Unpaid returns may result in deduction of incurred extra costs.

You are only liable for any diminished value resulting from handling beyond what is necessary to assess the goods' condition.

No right of withdrawal applies to sealed goods not suitable for return for health/hygiene reasons if the seal is removed.

§4 Prices and Shipping Costs Prices are stated in Euros and include VAT. The following shipping costs apply (excluding Germany):

·       Orders under €34.96: €19.00 shipping

·       Orders €34.96 – €54.94: €9.95 shipping

·       Orders from €54.95: free shipping

Other shipping zones:

·       Estonia, Finland, Greece, Lithuania, Latvia, Norway, Portugal: €23.00

·       Bosnia & Herzegovina, Croatia, Serbia: €36.00

·       Bulgaria, Romania: €47.00

·       Switzerland: delivery not available

§5 Payment Terms We accept payment by credit card and PayPal. The total is due upon order acceptance. LEMON reserves the right to exclude certain payment methods.

§6 Delivery and Retention of Title Delivery occurs within 1–3 business days of payment unless otherwise stated. Goods remain property of LEMON until full payment is received.

§8 Liability LEMON is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under product liability law. For slightly negligent breach of essential obligations, liability is limited to typical, foreseeable damages.

§9 Data Protection See our Privacy Policy for information about data processing.

§10 Undeliverable Shipments For parcels returned as undeliverable or unclaimed, we may charge actual reshipping costs. No flat fee will be charged.

§11 Governing Law German law applies excluding the UN Sales Convention. For consumers, this only applies if it does not remove protection by mandatory laws of the consumer’s residence.

§12 Dispute Resolution The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr. LEMON is not obliged or willing to participate in dispute settlement proceedings before a consumer arbitration board.

§13 Severability Clause If individual clauses of these terms are invalid, this does not affect the validity of the remaining provisions. Statutory law applies instead.
